WFC Annual Waiver, Release of Claims and Indemnification

Please read carefully. This affects your legal rights. By checking the waiver box on the WFC Fighter Registration form, you agree to this waiver for the calendar year you sign it. If you are under 18, a parent or legal guardian must also agree.

Each casino, venue or host property where a WFC event is held (each a “Venue”) and Catalyst Marketing Solutions, LLC (“CMS”) DBA World Fighting Championships (“WFC”) shall be collectively referred to as the “Protected Parties”.

Competitor agrees that, in exchange for the Protected Parties allowing Competitor the privilege of competing in any WFC boxing, MMA, kickboxing or other combat sports event held at any Venue from January 1 through December 31 of the Calendar Year Covered (each an “Event”), and the Protected Parties' agreement to record Competitor’s performance in each Event, Competitor will release the Protected Parties from liability for any damages suffered by Competitor in connection with any Event, and from liability for any compensation to Competitor for the use of Competitor's name and likeness. This release applies to every Event Competitor participates in during the Calendar Year Covered, and Competitor does not need to sign a new WFC waiver for each Event. Some Venues require their own separate waiver; where a Venue does, Competitor agrees to sign it, and that waiver applies in addition to this release.

INDEMNIFICATION AND HOLD HARMLESS.

In consideration for being allowed to enter and participate in any Event as a Competitor, Competitor hereby RELEASES and agrees to INDEMNIFY (including payment of attorney’s fees) and HOLD HARMLESS the Protected Parties and their respective owners, officers, directors, employees and agents, from any liability whatsoever regarding Competitor’s negligent acts, acts of omissions or acts of willful misconduct while on the property of any Venue, including during weigh-ins, fighter meetings, warm-ups and the Event itself.

WAIVER AND RELEASE OF CLAIMS.

Competitor is fully aware of the risks involved in combat sports in general, and any additional risks peculiar to the specific competition Competitor will be participating in at each Event. Competitor warrants that he is fully qualified and prepared to participate in each Event, and that his health is such as to place no unusual risks on his participation. Competitor agrees to tell WFC before an Event about any injury, illness or medical condition that arises after signing this release. In consideration for being allowed to enter and participate in any Event as a Competitor, Competitor hereby WAIVES and RELEASES the Protected Parties and each of their owners, officers, directors, employees and agent from any and all claims for any personal injury or personal loss of any type resulting from, related to, or occurring during any Event. If Competitor is injured during an Event, Competitor assumes the liability of the costs associated with injuries over the covered amount deemed necessary by the state for that Event, as well as all liability if Competitor does not follow proper protocol to insurance company. Competitor knowingly and voluntarily assumes all risks related to Competitor’s participation in each Event.

MODEL RELEASE.

Competitor grants to the Protected Parties the unrestricted right to record, edit, and compile Competitor's participation in any Event in any way desired by the Protected Parties, and to sell, distribute, or otherwise utilize the recording in any manner desired by the Protected Parties. Competitor agrees the consideration listed in this release is sufficient for this grant of rights, and Competitor will not seek additional compensation, regardless of the outcome of the efforts of the Protected Parties to sell or distribute the recording.

INDEPENDENT CONTRACTOR.

Competitor is and shall perform at each Event as an independent contractor, and shall not act, nor is deemed to be, an agent, member, employee, partner, joint venture or legal representative of Protected Parties. Competitor has no authority to assume or create any commitment or obligation on behalf of Protected Parties or bind Protected Parties in any respect whatsoever.

MISCELLANEOUS.

Competitor warrants that he has read and fully understands this release, is of legal age to contract (or, if under 18, that a parent or legal guardian has also agreed), and has had the opportunity to seek legal advice before signing. State law of Nevada shall govern this release, with the venue for any disputes to be in the state of the Event where the dispute arose. This release remains in effect through December 31 of the Calendar Year Covered. This release represents the entire understanding of Competitor regarding the subject matter hereof; any separate Venue waiver is in addition to, not in place of, this release.

CALENDAR YEAR COVERED.

The Calendar Year Covered is the calendar year in which Competitor agrees to this waiver online, unless a different year is written on a signed paper copy.

PARENT / LEGAL GUARDIAN.

If Competitor is under 18 on the date of signing, the parent or legal guardian who agrees to this waiver confirms they are the parent or legal guardian of Competitor, have read this release, and agree to it on their own behalf and on behalf of Competitor, including the release, indemnification and model release terms.
